Civil Litigation

What is Civil Litigation?

Civil litigation simply means that there is a legal dispute between two or more private individuals seeking money for damages or settlement of non-criminal disputes. This definition is very broad and includes contract cases, land disputes, divorce and custody, complex adoption disputes, and many, many other types of cases.

Mediation

Family Law Mediation is an alternative dispute resolution (ADR) tool. Meaning, mediation is an alternative to further litigation, including additional discovery and a costly trial. Mediation involves a neutral third party helping others reach an agreement.

Fox & Lutz can provide certified family law mediation services to parties already involved in litigation, or parties that have a dispute that are trying to avoid costly litigation. When serving as a mediator, Fox & Lutz uses a variety of techniques to open or improve the dialogue between parties involved in a dispute. When emotions are high, communication tends to break down.  We facilitate that communication and assist parties in coming “out-of-the-box” to find middle ground where they can agree.

Why Mediate?:

  1. Cost:  While there will be a charge for mediation services, in almost every situation mediation is less costly for each party than continuing litigation. Your case may be settled in hours, rather than months or years of litigation.
  2. Keeping Control: Parties have control over the outcome of their dispute when they come to an agreement during mediation. In a court trial, a judge will decide the outcome of your family dispute.  In a mediation, parties make the decision about what happens with their family through communicating and coming to an agreement within which each party can be comfortable.
  3. Children: Parties that have a child together have to maintain open lines of communication to co-parent their child(ren). It is no secret that a custody trial can become extremely heated and very ugly, leaving an already strained co-parenting relationship even worse. The worse that relationship is, the more difficult it is on the child(ren) involved. Mediation helps avoid that contentious trial.
